1. PURPOSE AND LEGAL EFFECT

These Winner Terms & Conditions ("Winner Terms") govern the acceptance, administration, fulfilment and post-award obligations associated with any prize awarded to a Winner of 10Alytics BuildFest 2026.

By registering for or participating in BuildFest, participants were required to review and accept the Competition Terms and Conditions published on the official BuildFest website.

The participant's electronic acceptance of those Terms, including clicking an "Agree", "I Agree", "Accept" or substantially similar button, checkbox or electronic confirmation, constitutes the participant's acceptance of the applicable Competition Terms to the extent permitted by applicable law.

These Winner Terms establish additional obligations applicable specifically to persons or teams declared Winners.

Acceptance, receipt or use of any BuildFest Prize constitutes acceptance of these Winner Terms and the obligations contained herein.

The Winner acknowledges that certain obligations in these Terms expressly continue after the Prize has been paid or delivered.

SECTION 2

2. INCORPORATION OF THE ORIGINAL BUILDFEST TERMS

These Winner Terms shall be read together with the Competition Terms and Conditions previously accepted by the participant on the BuildFest website.

The Winner acknowledges that:

  • they accepted the Competition Terms electronically;
  • their participation was subject to those Terms;
  • their status as a Winner does not terminate those Terms;
  • these Winner Terms provide additional obligations applicable to Winners; and
  • obligations that expressly or by their nature survive participation shall continue following completion of the Competition.

Where there is a conflict concerning the administration of a Prize, these Winner Terms shall govern the Winner-specific requirements unless applicable law requires otherwise.

SECTION 3

3. OFFICIAL WINNER STATUS

A participant shall become an official Winner only after the Organiser has formally confirmed the applicable result.

The Organiser may conduct eligibility, identity, project and compliance verification before or after announcing a Winner.

  • eligibility;
  • Competition rule compliance;
  • identity;
  • project ownership;
  • plagiarism;
  • fraud;
  • manipulation;
  • or other material matters affecting the validity of the award.

SECTION 5

5. PRIZE VALUE AND PROCUREMENT

The Winner acknowledges that the Organiser may obtain prizes through:

  • sponsors;
  • partners;
  • vendors;
  • distributors;
  • corporate arrangements;
  • negotiated rates;
  • bulk purchasing;
  • promotional arrangements;
  • partner credits;
  • or other commercial arrangements.

Consequently, the Organiser's allocated Prize Value may differ from the publicly advertised retail price of a product or service.

The Winner shall not be entitled to demand the public retail price of an item merely because a different price is displayed by a retailer, marketplace or third party.

Where the Organiser has expressly converted a physical or non-cash Prize into a monetary value, the communicated amount shall constitute the applicable Prize Value.

The Winner shall not independently select a vendor or require the Organiser to purchase a specific product or service unless the Organiser agrees in writing.

SECTION 6

6. PRIZE SUBSTITUTION

Where reasonably necessary, the Organiser may substitute a physical, digital or third-party Prize with another Prize of comparable or reasonably equivalent value.

This may occur where:

  • a supplier discontinues the item;
  • a third-party service becomes unavailable;
  • delivery becomes impracticable;
  • regulatory restrictions apply;
  • a vendor fails to fulfil the order;
  • or circumstances outside the Organiser's reasonable control prevent fulfilment.

  • identification;
  • email address;
  • telephone number;

  • payment information;
  • address;
  • tax information where applicable;
  • proof of team membership;
  • Project ownership information;
  • photographs;
  • signed declarations;
  • and other reasonable information required to administer the Prize.

Failure to complete verification may result in the Prize being withheld pending completion of the process.

SECTION 8

8. ACCURACY OF INFORMATION

The Winner warrants that all information supplied to the Organiser is accurate, complete and not misleading.

The Winner must promptly notify the Organiser if information relevant to Prize administration changes.

Materially false, fraudulent or misleading information may constitute grounds for disqualification, Prize forfeiture and/or other lawful remedies.

SECTION 9

9. TEAM WINNERS

Where a Prize is awarded to a team, the Organiser may require the team to designate an authorised representative.

The Organiser may rely upon written confirmation from the team regarding the authorised representative.

The Organiser shall not be responsible for disputes between team members concerning:

  • internal Prize distribution;
  • contributions;
  • ownership;
  • Project rights;
  • leadership;
  • or use of Prize funds.

Once the Organiser has fulfilled the Prize according to the agreed arrangement, any subsequent dispute among team members shall be resolved by the team members themselves.

SECTION 10

10. CASH PRIZE PAYMENT

Cash Prize payment shall be made following completion of required verification and administrative requirements.

The Winner is responsible for providing accurate payment information.

The Organiser shall not be responsible for payment delays caused by:

  • incorrect information;
  • banking restrictions;
  • payment-provider issues;
  • regulatory requirements;
  • foreign exchange processing;
  • rejected transactions;
  • or circumstances outside the Organiser's reasonable control.

SECTION 11

11. TAXES, BANKING AND CURRENCY

The Winner is responsible for applicable personal taxes, bank charges, payment processing charges, foreign exchange charges or similar obligations, except where the Organiser is legally required to withhold or remit an amount.

Where currency conversion is necessary, the Organiser may use the exchange rate or payment mechanism applicable through its bank or payment provider.

SECTION 12

12. MANDATORY POST-PRIZE TESTIMONIAL VIDEO

12.1 Binding Contractual Obligation

The Winner is expressly required to create and submit a positive and genuine BuildFest 2026 testimonial video after receiving the Prize.

The Winner acknowledges that this is a binding contractual obligation and a material condition associated with acceptance of the BuildFest Prize.

The Winner's receipt of the Prize does not cancel, waive or extinguish this obligation.

The obligation survives the disbursement of the cash Prize.

12.2 Three-Day Deadline

The Winner must create and submit the testimonial video within three (3) calendar days after the date on which the applicable cash Prize is disbursed.

For example, where the Prize is disbursed on 20 September, the video must be submitted no later than 23 September.

Any extension must be expressly approved in writing by an authorised representative of the Organiser.

Silence or failure by the Organiser to respond to an extension request shall not constitute approval.

12.3 Required Video Content

Unless otherwise instructed by the Organiser, the video must:

  • be approximately 30–90 seconds;
  • identify the Winner as a BuildFest 2026 Winner;
  • mention 10Alytics BuildFest;

  • be submitted through the channel specified by the Organiser.

The Organiser may provide reasonable talking points and technical specifications.

SECTION 13

13. FAILURE TO PROVIDE THE MANDATORY VIDEO CONSTITUTES MATERIAL BREACH

Failure or refusal to create and submit the required testimonial video within the prescribed period, without an extension expressly granted by the Organiser, constitutes a material breach of these Winner Terms.

The Winner expressly acknowledges and agrees that:

  • the requirement is mandatory;
  • the deadline is material;
  • the obligation survives Prize disbursement;
  • receiving the cash Prize does not release the Winner from the obligation;
  • refusing to provide the video does not constitute a valid cancellation of the obligation; and
  • the Organiser is entitled to enforce its contractual rights arising from the breach.

The Winner further acknowledges that:

SECTION 14

14. LEGAL ACTION FOR BREACH OF VIDEO OBLIGATION

Where a Winner fails or refuses to provide the required testimonial video in accordance with these Terms, the Organiser reserves the express right to commence legal proceedings against the Winner for breach of the contractual obligations applicable to the Prize.

The Organiser may, subject to applicable law:

  • issue a formal written notice of breach;
  • issue a letter of demand;
  • instruct legal counsel to communicate with the Winner;
  • commence court proceedings;
  • seek appropriate contractual or equitable relief;
  • seek an order requiring compliance where such relief is legally available;
  • seek recovery of losses legally attributable to the breach;
  • seek recovery of reasonable legal, enforcement and administrative costs where legally recoverable; and
  • pursue any other remedy available under applicable law.

The Winner expressly acknowledges that the Organiser intends to enforce this obligation and may pursue legal action where a Winner deliberately fails or refuses to comply.

Nothing in this section limits the Organiser's right to seek any other lawful remedy.

SECTION 15

15. FORMAL NOTICE OF BREACH

Where the required video has not been received by the applicable deadline, the Organiser may issue a written notice identifying the breach.

The Organiser may provide a final opportunity to remedy the breach within a specified period.

The Organiser is not required to provide repeated reminders.

If the Winner fails to remedy the breach following such notice, the Organiser may proceed with legal enforcement without further informal reminders, subject to applicable law.

SECTION 16

16. LEGAL COSTS AND LOSSES

To the extent permitted by applicable law, the Organiser reserves the right to seek recovery from a breaching Winner of losses, expenses and reasonable legal or enforcement costs incurred as a direct result of the Winner's breach.

Nothing in these Terms guarantees that a court or other competent authority will award any particular amount or remedy. Any recovery shall be subject to applicable law and the determination of the relevant authority.

SECTION 17

17. NO AUTOMATIC PRIZE DEDUCTION

The Organiser shall not make an unlawful deduction from a cash Prize already paid to a Winner.

Where a Prize has already been disbursed, any monetary claim arising from a breach shall be pursued through an appropriate lawful contractual or legal mechanism.

The Winner acknowledges that the Organiser's right to enforce the contractual obligation is not extinguished merely because the Prize has already been paid.
